What is NOM-035?

NOM 035 is an Official Mexican Standard decreed by the Government of Mexico, through the Ministry of Labor and Social Welfare (STPS 2018) with the purpose of detecting severe traumatic events that the employees of a company could have experienced and preventing them in the same psychosocial risk factors.

The results help companies prevent accidents and occupational diseases, promoting safe and adequate work environments for the correct performance of the tasks and functions associated with the positions.

How to apply the NOM-035 in my company?

This Standard must be applied in all workplaces in the Mexican national territory, taking into account the number of workers that work in the workplace:

  • Workplace with up to 15 workers: obligation to apply Reference Guide I to detect severe traumatic events.
  • Workplace with 16 to 50 workers: obligation to apply Reference Guide I to detect severe traumatic events and Reference Guide II for the identification and analysis of psychosocial risk factors.
  • Workplace with more than 50 workers: obligation to apply Reference Guide I to detect severe traumatic events and Reference Guide III for the identification and analysis of psychosocial risk factors and evaluation of the organizational environment in the workplace.

Phases of NOM-035

The first stage of NOM-035 in Mexico entered into force in October 2019, in this phase the obligation of the company consisted of:

- Establish and disseminate the risk prevention policy.
- Establish and disseminate prevention measures.
- The identification of workers exposed to severe traumatic events through the application of Reference Guide I.

The second stage will take effect on October 23, 2020. From this date the company must carry out:

- The identification and analysis of psychosocial risk factors.
- The assessment of the organizational environment, control measures and actions.
- The practice of medical examinations.
- The documentation or records.

What are psychosocial risk factors?

According to the Official Guide of the Ministry of Labor and Social Welfare, psychosocial risk factors are those that can cause anxiety disorders, non-organic disorders of the sleep-wake cycle and severe stress and adaptation, derived from the nature of the functions of the job, the type of work day and exposure to severe traumatic events or acts of workplace violence against the worker, due to the work carried out.

They understand dangerous and unsafe conditions in the work environment; workloads when they exceed the capacity of the worker; lack of control over work; working days longer than those provided for in the Federal Labor Law, night shifts; interference in the work-family relationship, negative leadership, and negative relationships at work.

How to do a Psychosocial Risk Assessment?

What are the Reference Guides of NOM-035?

The Official Gazette of the Federation published on October 23, 2018 the Standard that compiles the questionnaires that companies must provide to their workers and which are summarized as follows:

Reference Guide 1 NOM-035

Questionnaire to identify workers who were subjected to severe traumatic events; such as accidents, violent acts or others.

In addition, with the application of this guide, the level of affectation that these have had on the person who could have suffered them is evaluated.

This is a fundamental process, all companies in Mexico, regardless of their size, must evaluate these factors in their workplace.

Reference Guide 2 NOM-035

Guide 2 refers to a questionnaire that allows the identification and analysis of psychosocial risk factors.

Conditions of the workplace are evaluated, as well as the amount and pace of work. Aspects related to activities and responsibilities, the time dedicated, the reconciliation between personal and work life, possibilities for professional development, training and information that the employee receives, relationship with co-workers, clients who demand a significant degree of attention, as well as such specific obstacles that can occur when leading other team members.

It is aimed at companies with up to 50 workers.

Reference Guide 3 NOM-035

Guide 3 proposes a questionnaire for the Identification and analysis of psychosocial risk factors and the evaluation of the organizational environment.

In addition to what is compiled in Guide 2, Reference Guide 3 adds specific aspects of the organizational environment such as: recognition of performance, job stability, feeling of belonging, etc.

This evaluation is aimed at groups of more than 50 people.
